General terms and conditions

FAMILYDEVICE · AS OF OCTOBER 2026

These terms govern the use of the familydevice app for iPhone. Purchase and subscription are handled via Apple’s App Store.

§ 1 Scope

These general terms and conditions (terms) apply to the use of the iOS app “familydevice” of ANTICIPATER GmbH, Alter Schlachthof 39, 76131 Karlsruhe (hereinafter “provider”). In addition, Apple’s end user licence agreement (Standard EULA) applies in its currently valid version. In the event of contradictions, Apple’s provisions on purchase, billing and cancellation take precedence.

§ 2 Service

familydevice is an app for guiding children’s screen time. It uses Apple’s Screen Time interface (Family Controls) to block apps and websites on a child’s iPhone according to schedules, and to request and grant approvals. The parent’s and kid’s iPhones are paired directly with each other; messages between the devices are end-to-end encrypted and are transmitted directly when nearby, otherwise via the users’ iCloud. The provider does not operate its own server for this.

Requirements are an iPhone with iOS 17 or later, for the kid’s iPhone a child account in the parents’ Apple Family Sharing, and iCloud enabled for transmission over longer distances.

§ 3 Conclusion of contract, prices and subscription

The app is free in the App Store. As long as no kid’s iPhone is paired, setup and simulation are free. As soon as a kid’s iPhone is paired, using the parent features requires a subscription: €10 per month for the first child and €1 per month for each additional child. There is no further surcharge for more than six children. If you pair another child, the subscription is changed to the new number via the App Store. All prices include statutory VAT.

Purchase and subscription are concluded via the Apple Account and billed by Apple. The subscription renews automatically for one month at a time unless it is cancelled in the Apple Account settings at least 24 hours before the end of the current period. Refunds and withdrawal are governed by Apple’s terms.

If the subscription ends, existing blocks on kids’ iPhones remain in effect for safety reasons until they are changed by the parents or the devices are unpaired.

§ 4 Users’ obligations

You confirm that you are of legal age and have parental responsibility for, or are otherwise authorised for, the kids’ iPhones you set up. You protect your parent PIN and the Screen Time passcode from access by your child. familydevice must not be used to control other adults’ devices without their knowledge.

§ 5 Technical limits

In particular, an iPhone can be erased by people who know the device passcode and the Apple Account password; familydevice detects this and reports missing check-ins, but does not prevent it. The function depends on Apple services (Screen Time, iCloud, notifications) over whose availability the provider has no influence.

§ 6 Liability

The provider is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 7 Changes

The provider may develop the app further and change these terms with effect for the future, insofar as this is reasonable for you. We will inform you of significant changes in the app or on familydevice.com. Price changes to the subscription are announced via Apple and, where provided for by Apple, require your consent.

§ 8 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of the country of your habitual residence remain unaffected. The place of jurisdiction is Karlsruhe if you are a merchant, a legal entity under public law or a special fund under public law. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
